Its situational. It all depends on how badly you screwed the job up, how badly they want it back, and what the item is. I don't think police will give a fuck about an ipod unless there is a lot of damning evidence against you.

The item still belongs to the original owner. It is not until the statue of limitations, I think it's like 2 years, takes effect that the item is now the possession of the thief.
